Appeal from the grant of summary judgment in favor of the debtor, Drexel Burn-ham Lambert Group, Inc. (“Group”), granted by Bankruptcy Judge Francis G. Conrad on a claim against the bankrupt’s estate seeking to establish a constructive trust on a part payment for assets purchased by P.T. Tirtamas Majutama (“Appellant”) from Group prior to the latter’s bankruptcy. The money received on the transaction, as well as all of Group’s other funds, were completely dissipated before the bankruptcy, as was shown by a tracing permitted of all of the bankrupt’s…
