REVISED OPINION
VAN NORTWICK, J.
Eugene Smith challenges a final judgment entered in favor of the appellees, Reginald Bruster and David Morgan, following entry of an order dismissing Smith’s amended complaint with prejudice. We reverse the final judgment as to Brus-ter and Morgan, and we remand for further proceedings.
