FERREN, Associate Judge:
A jury convicted appellant Robert Jones, Jr., of possession of heroin with intent to distribute. See D.C.Code § 33-541(a)(l) (1988 Repl.). The trial court sentenced him to five to fifteen years of imprisonment, with a mandatory minimum of four years. Appellant contends on appeal that the trial court committed reversible error when it gave an “acquittal first” instruction after the jury had announced it was deadlocked.
