NEILL, Associate Justice.

— This is an action brought by David E. Higdon against the San Antonio Traction Company to recover damages for injuries alleged to have been committed by the negligence of the defendant upon Susan I. Higdon, the plaintiff’s wife.

The negligence averred in plaintiff’s petition is as follows:

“That heretofore, to wit, on or about the 1st day of October, 1907, Ihe said Susan I. Higdon was a passenger upon one of defendant’s street cars, which was being propelled by the means of electricity, and when said car had reached a point on San Pedro avenue and at or-near the corner…
