On February 7, 1938, about 6 :30 in the morning, a heavily loaded truck of the defendant and a passenger automobile operated by plaintiff’s decedent, B. D. Russell, collided on U. S. Highway No. 1 at a point four miles East of the Town of Leesville, in Lexington County. At the time of the accident the vehicles were traveling in opposite directions, the truck going West, towards Augusta, and the car going East, toward Columbia.
