Appeal from a judgment of the superior court for King county, Mackintosh, J., entered May 29, 1913, in favor of the defendants, notwithstanding a verdict of a jury rendered in favor of the plaintiffs, in an action for wrongful death.

For nearly five years prior to October 7, 1911, Ella Jennie Johnston had been a tenant of the defendant, occupying premises in the city of Seattle. In the summer of 1911, the street in front of the property was improved by regrading and the building was adjusted to the new grade by putting a brick story under the frame structure that had been the subject of the tenancy. Mrs. Johnston had remained in the building during the period of repair or reconstruction.
