This is an appeal by the State Board of Parole from an order of the Supreme Court at Special Term which directed the release on parole of petitioner, Edward J. O’Con-nor, who was serving an indeterminate sentence of imprisonment. Petitioner had been convicted June 28, 1940, upon a plea of guilty, of the crime of grand larceny, second degree, and was sentenced to an indeterminate term of not less than two and not more than four years’ imprisonment. His maximum sentence would have expired July 1,1944.
