ROSEN, District Judge.

Michael Brown (“Petitioner”), an inmate at the Bellamy Creek Correctional Facility in Ionia, Michigan, has filed an application for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. In his application, filed pro se, petitioner challenges his conviction on one count of use of a credit card without cardholder’s consent, M.C.L.A. 750.157q; M.S.A. 28.354(16), and being a third felony habitual offender, M.C.L.A. 769.11; M.S.A. 28.1083.
