ALTIMARI, Circuit Judge:
Walter L. Jones, pro se (“Jones”), and the Walter L. Jones Development Corp. (“the Corporation”), appeal from an order of the United States District Court for the Western District of New York, John T. Elfvin, Judge, dismissing appellants’ complaint pursuant to Fed.R.Civ.P. 37(b)(2)(C). Judge Elfvin dismissed the action because of Jones’ persistent refusal, in the face of warnings by the court and the Corporation’s attorney, to answer any questions at a duly scheduled deposition.
