J. This case comes here upon a writ of error, sued out more than two years after the entry of final decree below, by Jenkins, as assignee in bankruptcy of Samuel J. Walker, the mortgagor and one of the defendants below, in a suit in equity, to foreclose a mortgage. Jenkins assigns errors of law; and, to such assignment, defendants in error have interposed a plea of confession and avoidance based upon the provision of the bankrupt act, prescribing a limitation of two years to the bringing suits by such assignees in certain cases.
