These are appeals from judgments and orders of the Court of Common Pleas of Warren county granting motions for new trials in two cases which had been consolidated for trial.

On September 18, 1967, at approximately 9:30 p. m., Edith Phillips, who with her husband was plaintiff in one of the cases before us, was driving an automobile on a public thoroughfare in Warren county.
