The plaintiff in error was indicted for perjury, charged to have been committed on the trial of an indictment for arson against one Samuel Williams. The testimony charged to be false was *430to the effect that said Samuel Williams was at the house of said Brown at 7.30 o’clock on the night preceding the burning, then went to bed with Brown, and slept with him till the next morning at 4 o’clock, when they were awakened by an alarm given of the fire.
