Assumpsit, brought by the receivers of the Litchfield Bank in the name of the bank. The declaration contained several counts upon certain promissory notes execnted'by the defendant to the bank, and held by the bank at the time of its failure, amounting together to the sum of $2,056.44, and a count upon a subscription of the defendant to the capital stock of the bank at the time of its organization.

We will dispose of some of the minor questions in the case before we proceed to express our views upon those which have been treated as more serious and important.

And first, as to the motion in arrest. This is founded, in part, on the circumstance that the court adjourned to the house of Mr. Spencer, a few rods from the court house, for *147the purpose of receiving the verdict of the jury, because of the sudden illness of one of the jurors.
