APPEAL from a judgment of the District Court of the Fourth Judicial District, in and for the County of Yavapai. Edward M. Doe, Judge. The facts are stated in the opinion.

The appellant was tried at the November, 1910, term of the district court of Yavapai county, upon an indictment charging him with the crime of arson. He was convicted and sentenced to a term of three years in the territorial prison. He appeals to this court from the judgment of conviction and from an order denying his motion for a new trial and in arrest of judgment. The appellant has made no appearance in this court, either in person or by counsel, and the matter comes here solely upon the record.
