Owens v. Liberty Mutual Insurance Co.

The majority is correct in denying plaintiff additional compensation for his injury. However, this writer approves of the test found in Montagnino v. Allstate Insurance Company, 336 So.2d 235 (La.App. 1st Cir.1976), writs denied 339 So.2d 24 (La.1976) upon which the Court of Appeal rested its decision. The record shows that plaintiff has met none of the requirements of this test.
