GILLIAM, District Judge.

This case arises out of a collision between the oil screw Dewey, a menhaden *558fishing vessel owned by the respondents, and the shrimp trawler Dixie B owned by the libelant. The collision occurred on the morning of November 12,1954, in the waters off Cape Lookout, N. C. The libelant and the respondents are citizens and residents of this District. The Dewey is within the District. Respondents admit the negligence of the Dewey, but contend that the Dixie B was also at fault and that damages should be divided.
