Woods, Judge:

II. W. Perkins, M. O. Litz and Easley-Litz Pocahontas Coal Land Company, a corporation, prosecute this writ of error to a judgment of the circuit court of McDowell County entered against them and J. Logan Hill as indorsers on a certain $5',000.00 promissory note, following a verdiet in favor of the plaintiff, suing as a holder in due course, for the face of the note, plus interest.

The note in question was dated August 1, 1923, and payable at the plaintiff bank six months after date to the Easley-Litz Pocahontas Coal Land Company, hereafter designated as the Easley-Litz Company.…
