This appeal resulted from the entry of an order, upon a writ of habeas corpus issued, directing W. K. Cunningham, Jr., Superintendent of the Virginia State Penitentiary, to release from his custody Carl Hayes, who is being detained on a judgment order of the Circuit Court of Mecklenburg County entered October 29, 1957, whereby Hayes was sentenced to life imprisonment on a conviction of murder in the first degree.

On May 17, 1962, Hayes filed a petition for a writ of habeas corpus in the Hustings Court of the City of Richmond, Part II, wherein he asserted that his detention was illegal. He…
