LIVINGSTON, Chief Justice.

Meyer E. Wolf, individually and doing business under the trade name of Meyer E. Wolf Company, sued the Mobile Battle *634House, Inc., a corporation, for the loss of a sample case containing a large number of diamonds while he was a guest at the defendant’s hotel.
