This appeal arises from an. action instituted by appellant Leon Coleman against appellee Morris Mitnick for damages allegedly resulting, - from the alleged false imprisonment and malicious prosecution of Coleman by Mitnick. The first paragraph of appellant’s complaint essentially alleges that appellee “wrongfully and unlawfully imprisoned- Coleman” to appellant Coleman’s damage of one thousand ($1.000) *127dollars. The second paragraph alleges malicious prosr ecution by appellee. Appellee filed an answer in general denial to these paragraphs.
