MEMORANDUM OPINION AND ORDER

Introduction

This litigation involves an action by members of the Brotherhood of Railway, Airline and Steamship Clerks (BRAC) to invalidate a dues increase voted by the 24th Regular and Tenth Quadrennial Convention of BRAC on May 28, 1971. This cause is now before the Court on remand from a decision by the Court of Appeals for the Seventh Circuit; that court reversed an order granting defendants summary judgment on plaintiffs’ claim under the Labor-Management Reporting and Disclosure Act.
