On the 7th day of February, 1898, the State of West ■Virginia filed her bill in the circuit court of Doddridge County for the purpose of selling for the benefit of the school fund various tracts and parcels of land, and. gas and oil interests in other tracts, as set out and described in the bill; alleging that certain of said lands are liable to sale *452as waste and unappropriated', and others were forfeited for the nonpayment of the taxes thereon for the years men-iioned, and certain estates or interests in lands of said county of Dodridge had not been charged with the taxes…
