delivered the opinion of the Court.
It is urged that the court erred in refusing to permit plaintiff in error to amend her declaration. An examination of the record shows that the court offered to permit the amendment to be made, expressing the opinion at the time, however, that the amendment would do no good. Plaintiff in error did not except to this remark, or seek to take advantage of the leave granted, and hence is in no position to insist that the court ruled erroneously upon this branch of the case.
