L. c. 106, § 71, cl. 1, 2,) for injuries sustained on August 31, 1900, while in the employ of the defendant, the declaration being described in the second paragraph-of the opinion. Writ dated October 9, 1900. At the trial in the Superior Court before Fox, J. the jury returned a verdict for the plaintiff in the sum of $600; and the defendant alleged exceptions, raising the questions stated by the court.

This is an action of tort to recover for personal injuries received while in the employ of the defendant by reason of a bar of iron slipping off a truck on which it was being moved thereby causing the handle of the truck suddenly to fly around and strike the plaintiff.
The declaration contained three counts.
