Appeal by the defendant, The City of New York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 29th day of July, 1905, upon the verdict of a jury for$25,000, reduced by stipulation to $15,000, and 'also from an order entered in said clerk’s office on the 23d day of June, 1905, denying the said defendant’s motion for a new trial made upon the minutes.

McLaughlin, J.:

There have been two trials of this action. On the first the plaintiff had a verdict against the city of New York and the defendants Miller and Holme for $22,000, but on appeal the judgment was reversed as to the city and a new trial ordered, and also reversed as to Miller and Holme unless the plaintiff stipulated to reduce the ver- • diet to $15,000, in which* case the judgment was affirmed. (Coolidge v. City of New York, 99 App. Div. 175.) The stipulation was made and the verdict accordingly reduced against Miller and Holme to $15,000, upon which judgment was entered. The…
