The defendant, Israel Soto, has submitted a motion dated April 30, 2010, seeking dismissal of the instant indictment pursuant to CPL 190.50. The defendant has been indicted for burglary in the second degree and related offenses. It is alleged that, on March 15, 2010, the defendant broke into the complainant’s residence in violation of an order of protection.
