This action, was brought by plaintiffs in error for the use of Richland County, against Frank P. Gillespie, and the sureties upon his official bond as county collector of said county, to recover for alleged breaches of the condition of said bond. Defendants below interposed a general and special demurrer to plaintiff’s declaration, which demurrer the court sustained, and plaintiff elected to abide by the declaration and sued out this writ of error.
