Appeal by the defendant, Morris Schinasi, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 14th day of March, 1917, upon the verdict of a jury for $1,000, and also from an order entered in said clerk’s office on the 15th day of' March, 1917, denying defendant’s motion for a new trial made upon the minutes.

Scott, J.:

Defendant is the owner of an apartment or tenement house in the city of New York. The ground floor is occupied by shops. In November, 1914, the plaintiff while passing along *764the street in front of defendant’s" building stepped into a small hole in the sidewalk, turned her ankle and fell, suffering the injuries for which she sues. There is no question raised as to the happening of the accident, the extent of the injuries or the amount of the verdict. The only question is as to defendant’s liability.
