Plaintiff Gray commenced an action against the defendant in justice court. Judgment was rendered in bis favor and the defendant appealed to the district court. While this action was pending in the distric court plaintiff Vessey was permitted to intervene.
Judgment was rendered in favor of the plaintiffs in the district court and the ffendant made a motion for judgment notwithstanding the verdict nick motion was denied.
