The statute makes it an offence for “ any druggist or druggist’s clerk ” to sell liquor on Sunday, “ unless the person, to whom the same is sold, * * shall have first procured a written prescription therefor from some regular" practicing physician of the county.” R. S. 1881, section 2099.

In Barton v. State, 99 Ind. 89, it was held, in a carefully considered and well written opinion, that the provision of the statute requiring a written prescription is imperative, and we can see no possible reason for departing from that opinion, for it gives just effect to the words of the statute, prevents…
