This action was instituted by the appellee, Schwing, as surviving partner of the firm of J. Balmforth & Co., against the Royal Insurance Company, to recover on a policy of insurance for the loss of certain produce and goods that were destroyed by fire on the eighth of January, 1886, in a building in the city of Louisville, on Main, between Eighth and Ninth streets, at the time occupied by the firm.
