The appellant, Carl Eugene Allen, was indicted for sexual abuse in the first degree and sodomy in the first degree, violations of §§ 13A-6-66 and13A-6-63, Code of Alabama 1975, respectively. He was convicted of sexual abuse and acquitted on the sodomy charge. He was sentenced to 18 years' imprisonment in the state penitentiary.
The states evidence tended to show that the appellant sexually abused his stepdaughter, E.K., over a period of five years. E.K., who was 13 at the time of the trial, testified that the appellant began touching her in "private places" between her legs when she was 6…
