—The appellee was a section hand in the employ of the appellant company. On the 13th day of June, 1906, he was injured by the derailment of a handcar upon which he and other employes were at the time riding. The accident was caused by the section foreman falling from his seat on the front end of the car, across the track, and throwing the car off.
