Under section 67 of article 4, chapter 9, part 1 of the Revised Statutes, as amended by the Laws of 1850, chapter 283, section 1, on or about the 30th day of September, 1887, the Bartholomay Brewing Company filed with the defendants, as commissioners of the land office, its application for title to certain lands under the waters 'of Lake Ontario, at Charlotte, in the county of Monroe, which application was • opposed by the relator upon the ground that he was the owner of a portion of the adjacent uplands.
