This is an appeal from the' district court of Cotton county, wherein on the 10th day of July, 1918, the plaintiff in error, Henry Peyton, hereinafter designated defendant, was convicted of the crime of manslaughter in the first degree, and sentenced to serve a term of 18 years' imprisonment in the state penitentiary. From the judgment rendered against him, he has appealed to this court, and relies for a reversal on the grounds that the evidence is insufficient to sustain the conviction, that the verdict was the result of passion and prejudice on the part of the jury, and that the trial court…
