I can neither accept the conclusions nor the reasoning of the majority opinion in this case, for, in my opinion, this decision becomes a precedent without a parallel, vicious in principle and injurious in practice — a precedent which enables the common carriers of the country to ride booted and spurred over the rights of the .shippers and to treat with contumacy the courts of the *813country and to defile justice in her own temple.
