LAND, J.
On the first hearing of- this cause we sustained the exception of no- cause of action filed by the defendants. This exception necessarily admits the truth of the allegations of fact disclosed by the petition, and more especially that the bank and Bodenheimer never had any title to the tract in dispute, and therefore had no ownership to transfer to the plaintiff, and, further, that there is a paramount outstanding legal title in the Hanson Lumber Company, derived through mesne conveyances from the United States.
