The defendant was tried for murder in the county of Grand Forks, on a change of venue from Pembina county. He was convicted of murder in the second degree. He states in his brief on appeal, that the defense was upon two theories, first: “If the testimony of the only two living eye witnesses is time, then the defense of self-defense, defense of mother, and accidental homicide, either, or two or more concurring, were responsible for the death of the father:”
