This case originated in justice’s court in 1913. In the circuit it was tried before the judge *350without a jury and findings of fact and conclusions of law were duly filed. By appropriate proceedings defendant preserved all questions for review, including the question of whether the findings are against the weight of the evidence. This question we will first consider. Much space is taken in both briefs with a discussion of the facts.
