In an action, inter alia, to recover payment for goods sold and delivered, the plaintiff appeals from so much of an order of the Supreme Court, Nassau County (Goldstein, J.), dated November 1, 1989, as denied that branch of its motion which was to dismiss the second affirmative defense and counterclaim.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, and that branch of the motion which was to dismiss the second affirmative defense and counterclaim is granted.
