The appellee in this suit seeks a judgment against W. A. McCullough as the maker, and the Parlin & Orendorff Im-,— plement Company as the guarantor, of two promissory notes for $2,500 each. Both notes^were dated June 6, 1912; one was due January 1, 1919, and the other one year later. Each bore interest at the rate of 8 per cent, per annum, which' was payable annually on January 1st. Both notes contained stipulations for the payment of attorney’s fees in the event they were placed in the hands of an attorney for collection or suit was instituted thereon.
