On May 10,1993, Defendant-Appellee Brian Luton was charged with murder in the second degree, in violation of Hawai'i Revised Statutes (HRS) § 707-701.5(1), 1 and burglary in the first degree, in violation of HRS § 708-810(1)(e). 2

On March 16,1994, Luton filed a Motion in Limine to Determine the Voluntariness of Defendant’s Statements.
