This matter is before the Court on plaintiffs Motion for Preliminary Injunction and Declaratory Judgment and Motion for Judgment on the Administrative Record. A Court should always be reluctant to issue any injunctive relief. Injunctive relief intrudes upon the person’s or agency’s autonomy and decision making expertise. However, when it is required by the law and justice, the Court should not hesitate.
