The petitioner has filed in this court his verified petition for mandamus, which, omitting the formal parts, reads as follows:

“Comes now James F. McCullough, and for his petition alleges and states; That he stands charged by indictment in the district court of Craig county, Okla., of the crime of embezzlement in cases Nos. 1165 to 1177, inclusive, now pending on the criminal, docket of said court, and that respondent is the presiding judge of said court.
