The plaintiff’s complaint was oral. As supplemented by bills of particulars, it sets forth the following facts -. At about 11:00 a. m. on August 2,1947, the Maryland Syndicate caused to he delivered to defendant’s office in Baltimore, Maryland, the following telegram, for transmission to the plaintiff:
