Arthur, J.-

I. Jacob W. Lyons bought and settled on 120 acres of land in Carroll County in the year 1882, with his wife and three children. The children were J. A. Lyons, plaintiff in this action, Emanuel Lyons, and Isaac N. Lyons. The Avife of Jacob W. Lyons, mother of J. A., Emanuel, and Isaac, died- in the spring of 1883. Jacob W. Lyons married again in 1885. The children of Jacob W. Lyons and Sarah Lyons, his second wife, are tire defendants in this action: W. I. Lyons, Harry M. Lyons, Ulrich S. Lyons, Arthur R.
