—In an action to recover *826damages, inter alia, for breach of contract, defendant Town of Mamaroneck appeals from an order of the Supreme Court, Westchester County (Dickinson, J.), entered March 27, 1984, which denied its motion to dismiss the complaint as against it for plaintiffs failure to file a verified notice of claim in accordance with Town Law § 65 (3).
Order reversed, on the law, with costs, motion granted, action dismissed as against appellant, and action as against the remaining defendants severed.
