Appeal from an order of the Supreme Court, made at Special Term, entered in the New York county clerk’s office on the 22d day of Hovember, 1912, setting aside an order for the examination of a defendant before trial.

The action is brought by the trustee in bankruptcy of Herman W. Hoefer to set aside certain conveyances, for an accounting of the rents and for possession of the premises conveyed, on the ground that the said conveyances were made for the purpose of hindering, delaying and defrauding creditors pursuant to a secret agreement and conspiracy that the property should be held for and reconveyed to the bankrupt upon his request.
