Plaintiffs allege that they are holders and owners of two notes made by the defendant — the one for $6,457.64, dated April 19, 1898, payable March 1, 1899; the other for $2,000, dated August 3, 1898, paya*540hie February 1, 1899 — each of them bearing interest at the rate of 8 per cent, per annum from maturity, being secured by mortgage, and calling for 10 per cent, attorney’s fees in case of suit.
