WOOD, District Judge.

At the outset, it is advisable to point out that all counsel for the respective parties agreed that the factual situation in this case was one of first impression. Insofar as the legal consequences arising therefrom are concerned, no specific case in point was available in this district or elsewhere. The facts are as follows:
